Today I got a question from Chris about non-Endorsement Review for Tier 1 Exceptional Talent Visa. All we know about the Review process which is clearly explained in the updated Home Office Guidelines. But, as you see, the question is slightly not about the legal stuff but about life.

Question: “Hi Andrii – my question is – have you heard of or know of any success stories of Tech nation visa holders after they submitted a reassessment of the endorsement refusal?”

As an answer to this question, I decided to highlight at least five reasons why you must apply for non-Endorsement review and here we are.

1. The Endorsement Review is free of charge

You have already paid for the first stage of Tier 1 Exceptional Talent Visa so the review of the decision where you are not endorsed as an Exceptional Talent or Exceptional Promise is included in that price. One more positive thing about “free of charge” – you do not spend extra time and you do not need to provide proof of payment. Sometimes these two factors are also crucial.

2. It is 50:50 lottery – Review can be successful

I can confirm that personally I know people who were successful in their Review application. They were not endorsed on initial Tier 1 Exceptional Talent Visa application but after the Review, they got their Endorsements. Kind of success stories.

3. You do not need to submit any additional documents

The review is, literally speaking, re-considering your visa application. Hence, it is impossible to add anything new or attach a bunch of documents.  You provide only your arguments about the facts that were underestimated or mistakenly considered by the Endorsement Panel. Yes, on the one hand, it may be a problem since frequently applicants understood their mistakes only after pressing the button “Submit”. But, on the other hand, this is a logical procedure since you cannot review the case if there is new evidence. You must consider it with a new start but not as a review.

4. Time for non-Endorsement Review is quite short

You have only 28 days to apply for the Review if you were not successful with Endorsement. That is why, please, act as quick as you can! Personally, I completely understand why this period is so short. Because, I think, it will take so much efforts to deal with cases if people will apply after three or five months of non-Endorsement…

By the way, the actual review after submitting your appeal is also not too long. Depending on the workload, it may take a couple of days or up to two weeks.

5. Review does not require any extra-legal skills

Very good point! You can apply for the Review by yourself. You need to submit just one form and you can fill it by yourself. Only you know your visa case in details. Hence, you just need to understand what point of it was not considered properly by the Endorsement Panel.

At the same time, I understand that sometimes, apply for non-Endorsement review may be a hard task. Or, maybe, your English is not ideal so you cannot clearly explain what arguments you have. Or, even, you don’t know what to write in this Review. Hence, there is always an option to go to more experienced people.
