It is a crash of the whole world when a person gets an email from the Home Office where the question “Do you endorse the Tier 1 (Exceptional Talent) application for the above-named applicant?” is answered “No”. In other words, refusal decision is the last thing anyone is expecting after so long and hardworking preparations of Tier 1 Exceptional Talent Visa application. So what to do if this sad reality comes to your life?

First of all, you really have a reason to be disappointed at least for a day. It is the stressed situation and it is not completely adequate to stay calm or be positive after the refusal decision about Talent Endorsement. However, your depression should not last more than a day or two. There are further steps to do in order to reach your goal and be accepted by the United Kingdom as a Talent in Digital Field.

Endorsement Review of Refusal Decision

Home Office is writing in a detail about the procedure of endorsement reviews in paragraphs 37 – 38 of the Guidelines. Endorsement Review is the mechanism for reviewing refusal decisions made under the Tier 1 Exceptional Talent Visa application on Stage 1, where an applicant believes an error has been made in the decision. This option is only available for a Tier 1 Exceptional Talent (not Tier 1 Exceptional Promise) application for endorsement.

Literally speaking, after getting bad news about endorsement an applicant has a right to apply for Endorsement Review during the next 28 days after the refusal decision. This procedure is free of charge and does not require attaching any new documents.

Apply with new evidence to the same visa route

After correction the mistakes and updating your supporting documents, re-writing Personal Statement and sometimes even obtaining new Recommendation Letters – a person can apply for Tier 1 Exceptional Talent Visa (or Tier 1 Exceptional Promise Visa) again.

The cost of the application will be the same as previously – £ 292 for the Endorsement Stage. Since this application will be completely fresh, there is no link with your previous documents and facts. Hence, you need to forget about any previous attempts to apply for this talent visa, do not make any references to previous application and make everything from the clean sheet of paper.

Apply for a different visa route

This is completely another story since you go out of the Tier 1 Exceptional Talent Visa route and go to the direction of some other UK immigration visa. There are very specific rules for every type of visa. That is why in most cases, documents that you have already got for Tier 1 Exceptional Talent Visa application will not be relevant.

    I’ve applied on 20th November for Tier 1 Exceptional Promise in Fashion for endorsement and it’s decision come today where they mentioned that “ENDORSEMENT NOT RECOMMENDED” and in further details they mentioned that:

    Further Details (if required):
    Letters of support – All three letters support the Exceptional Promise of the applicant and come from
    respectable and recognised sources. However, none of these sources are UK organisations. As it is
    essential eligibility criteria that at least one letter of support must come from a UK organisation
    endorsement cannot be recommended.

    Media recognition – At least two examples of media recognition have been provided from at least one
    country however, the evidence does not provide a specific critique or review of the applicants work in the
    fashion design industry.

    Evidence of industry recognition – The applicant has recieved recognition for the quality of their work
    however the evidence comes from a group not directly associated with the fashion industry.

    I am an overseas fashion designer of an Norwegian sports clothing brand who compete with Adidas, Nike and others and my designed all clothing and apparels are more popular then Adidas and Nike in Norway and closest countries. My this Norwegian brand’s designed clothing and apparels attires in Miss Universe Norway 5th times and Miss Universe Norway Director provided me recommendation letter on Miss Universe Official Letterhead with my Norwegian sports brand’s CEO recommendation letter as well, and another recommendation letter I’ve took from my very old employer from my home country.

    On endorsement letter, they also mentioned that one letter must come from UK but I read on their guide that “If you are applying for Exceptional Talent then you must submit one letter from UK organization” so I thought it is not for promise.

    On my exceptional promise endorsement letter they also mentioned that I have right to review for re-asses, so I need your kind help, what should I do now? will my review endorse me if I review it? Do I need to apply again by same paper?

    If I review then will it be success without any new papers?

    1. Hi Sham, I believe you have to go to immigration lawyers and ask them about advice. It is difficult for me to suggest you any solution since I am a holder of Tier 1 Exceptional Talent Visa in Digital Technologies. It is completely different area.

    My Application for Exceptional Talent applied under the Exceptional Promise category has not been endorsed by Tech Nation (Stage 1).

    However I find this statement intriguing in the section “Further Specific Details”, where they have mentioned – ‘We do believe that the evidence submitted is sufficient to endorse for exceptional promise….” bu the text later on in this section is about how the evidence is insufficient.

    Could it be they are saying they refused under Exceptional Talent but they are endorsing it under Exceptional Promise.

    I got the following decision: The Royal Society has advised that you do not meet their criteria for Exceptional Promise and I am therefore satisfied that you cannot be endorsed under Tier 1 (Exceptional Talent).

    Due to 1) The evidence, as presented in the supporting statement(s), did not persuade the reviewers that the applicant should be endorsed for entry through the Tier 1 (Exceptional Talent) route. and 2) The reviewers considered that the applicant’s track record and contributions to the field to date, relative to career stage, were not strong enough to endorse the candidate for entry through the Tier 1 (Exceptional Talent) route.

    Please advice!
